Fat Joe & Remy Ma Are Reportedly Facing A Lawsuit Over “All The Way Up”

Miami-based rapper Fly Havana says his unreleased version of the hit is “identical to the released version.”

Fat Joe, Remy Ma, French Montana, and Infrared are facing a lawsuit over their 2017 hit, “All the Way Up,” according to reports by The Blast and Pitchfork. Miami-based rapper Fly Havana claims that his original, unreleased version of the song was created in 2015 and is “identical to the released version,” including the hook, the lyrics, the vocal melody, and the overall flow. Havana is seeking royalties from the song, credit for co-writing the song, and co-ownership of the song.

The lawsuit claims that Havana’s co-producer Infrared introduced Fat Joe to the song before cutting off communication with Havana. Joe allegedly met with Havana after the song was released and paid him $5,000, with the promise of more payments that never materialized.

It’s worth noting that Joe publicly thanked Havana for contributing to the hit during a live interview with Miami radio station 99Jamz. “Shout out Fly Havana, he worked on the record,” Joe said.

Havana’s version of “All the Way Up” features the following hook and bridge:

Nothin' can stop me, I’m all the way up
Yeah, I’m all the way up
I’m all the way up
I’m all the way up
Nothin' can stop me, I’m all the way up

Shorty what you want? I got what you need
See you smokin' lah, yeah we’re rollin' trees
In the club goin' up on the Medellin
Bring girls with you, let you know I’m with the team
Got bottles, got weed, got molly (I’m all the way up)
Shorty what you want? I got what you need
Shorty what you want? I got what you need
Shorty what you want? I got what you need

Infrared’s hook and French Montana’s bridge feature similar lyrics:

Nothin' can stop me, I’m all the way up
All the way up
I’m all the way up
I’m all the way up
Nothin' can stop me, I’m all the way up

Shorty what you want? Shorty what you need?
My niggas run the game, we ain’t ever leavin'
Countin' up this money, we ain’t never sleepin'
You got V12, I got 12 Vs
Got bottles, got weed, got molly (I’m all the way up)
Shorty what you want? I got what you need
Shorty what you want? I got what you need
Shorty what you want? I got what you need

“All the Way Up” was released in March 2016. Thanks to the boost it received from a JAY-Z-assisted remix, the single peaked at No. 27 on the Billboard Hot 100, netting Joe his first Top 40 hit since 2007’s “I Won’t Tell.” The track features production by Edsclusive and Cool & Dre.
